REGULAR MEETING – MADDEN ROOM – 7:30 p.m.

ITEM: CALL TO ORDER:

Chairman Wentzell called the regular meeting to order at 7:30 p.m.

There was no public participation for items not on the agenda.

ITEM: NEW BUSINESS:

Discussion/Decision/Action regarding the following:

Appl 03-83P, Berry Patch II, Metro Realty Group and South Windsor Housing Authority request for special exception to Article 4.1.11 and 7.1.2.4 and site plan approval for an additional 94 units and a waiver to allow up to 196 units for properties located on the easterly side of Buckland Road, southerly side of Oakland Road, and northerly of Deming Street, AA-30 zone, Buckland Gateway Development zone, and Floodplain zone

Banach reviewed the application.

Motion to approve Appl 03-83P, Berry Patch II, Metro Realty Group and South Windsor Housing Authority finding that it does not create adverse traffic impacts, or adversely affect the surrounding property values, and subject to the following conditions was made by Commissioner McCann:

Prior to commencement of any site work, a meeting must be held with Town Staff.
No building permit will be issued until the final mylars have been filed in the Town Clerk's office.
This application is subject to the conditions of approval of the Inland Wetlands Agency/Conservation Commission, including a bond in the amount of $25,000 for erosion and sediment control, and a bond in the amount of $20,000 to ensure installation and establishment of the stormwater structures.
An as-built plan is required prior to issuance of a Certificate of Occupancy per Section 8.1.10 of the Zoning Regulations.
A landscape bond in the amount of $10,000 is required and must be submitted prior to filing of mylars.
All plans used in the field by the developer must bear the stamp and authorized signature of the Town of South Windsor.
WPCA approval is required.
The building(s) street number must be included on the final plan.
The Commission hereby grants a waiver to Section 4.1.11.2.c to allow 198 total units.
Town Engineer’s review comments dated January 9, 2004, must be addressed to the Town Engineer’s satisfaction.
Required restrictive covenants to the South Windsor Housing Authority must be reviewed and approved by the Planning and Zoning Commission and the Town Attorney.
A sidewalk is required from Berry Patch II to Buckland Road and across Buckland Road frontage to the traffic signal at Terry Office Park.
The floodplain area near Buckland Road must be restored after construction with an attractive landscaping that includes seasonal interest wildflowers and shrubs.
The attached Special Exception form must be completed and filed in the Town Clerk’s office.  The special exception will take effect upon filing.
Seconded by Commissioner Kennedy.

Commissioner Choate inquired if a floodplain study was submitted.  Doolittle responded it was received.

Commissioner Larsen indicated she received copies of the tapes for the portion of the previous meeting she had missed.

Commission Kennedy commended the applicant for addressing all of the issues from the surrounding residences and from town staff.

Commissioner Larsen stated she has concerns with the size of this development being too large and a great majority of senior housing in the same location.  Larsen feels the senior housing should be spread out around the town.

Commissioner McCann commented the Commission approved and increased the cap of elderly housing and stated the location is near the Village of Buckland Court, one mile radius of Town Hall, library, doctors, supermarket and feels this an ideal location for this type of housing.

The motion carried and the vote was as follows: 6:1 McCann, Kennedy, Choate, Pacekonis, Slicer, Wentzell, aye; Larsen, nay

Appl 03-86P, East Hartford Sand & Gravel Phase 7, request for a renewal for earth removal operations for property located on the easterly side of Route 5 (1440 John Fitch Boulevard- behind KF Brick Properties), I zone

Banach reviewed the application.

Motion to approve with modification was made by Commissioner Kennedy:

Prior to commencement of any site work, a meeting must be held with Town Staff.
This application is subject to the conditions of approval of the Inland Wetlands Agency/Conservation Commission. The existing surety in the amount of $91,000 for wetlands mitigation must be maintained.
All plans used in the field by the developer must bear the stamp and authorized signature of the Town of South Windsor.
This permit is valid for a period of two years. The permit expiration date is January 27, 2006. The permit must be renewed prior to expiration if sand removal operations are to continue. A progress as-built plan is required with the permit renewal application.
Use of the driveway between the Sylvestri residence and this site by commercial/industrial vehicles is prohibited, in accordance with Section 3.4 of the zoning regulations.
The sequencing of excavation shown on the approved plans must be adhered to.
The existing bonds in the amount of $5,000 for site reclamation and $20,000 for erosion & sediment control must be maintained.
Commissioner Bazzano was appointed to sit for Commissioner McCann.  Commissioner Pacekonis was not present at the public hearing and did not vote on the application.

Seconded by Commissioner Choate.  The motion carried and the vote was unanimous.

Appl 03-93P, Corinne’s Studio, request for a five-year major home occupation for a hair salon for property located at 518 Graham Road, A-20 zone

Banach reviewed the application.

Motion to approve with modifications was made by Commissioner Choate.

The business must be operated by the homeowner.
Only one non-resident employee can be hired.
The permit will expire on January 25, 2009, and will have to be renewed at that time.
Refuse from the business cannot be disposed of with residential refuse. Adequate arrangements must be made for business refuse disposal.
Any new building, or alteration/addition to existing buildings, requires a building permit prior to start of construction.
Seconded by Commissioner Slicer.  The motion carried and the vote was unanimous.

Appl 04-02P, Peter DeMallie, Design Professionals, Inc., request for an amendment to Section 4.1.12.b&f of the zoning regulations to allow duplex units as a part of Senior Residence Developments and density requirements related to such use.

Appl 04-03P, Metro Realty Group request for zone change of 14,718 square feet of land from Gateway Development zone to AA-30 Residence zone for property located on the northerly side of Deming Street, easterly of Buckland Road and westerly of Grandview Terrace

Appl 04-04P, Metro Realty Group Resubdivision request for resubdivision of 3.7+ acres to create 3 new lots for property located on the northerly side of Deming Street, easterly of Buckland Road and westerly side of Grandview Terrace, AA-30 zone

ITEM: CORRESPONDENCE/REPORTS:

Chairman Wentzell indicated a meeting with the Zoning Board of Appeals and the ARDC Commission would be scheduled for February 17, 2004.

Chairman Wentzell mentioned the Commission should give some thought on forming a subcommittee regarding review of the zoning regulations.
